(Massachusetts Land Court, Boston, Massachusetts) (July 26, 2022) --- Fletcher Tilton litigation attorneys, Michael E. Brangwynne and Adam C. Ponte, secured a preliminary injunction against a residential abutter in a hotly contested land dispute matter located on Lake Chaubunagungamaug, also known as Webster Lake, Webster, Massachusetts. The firm’s client, a realty trust, learned that a new abutter to the trust’s lakeside property had illegally installed chains to prohibit access to the lake, along with camera equipment monitoring the subject access drive. The abutter had recently purchased the abutting property and shortly thereafter installed the violative equipment and chains. The defendant abutter’s conduct prohibited the plaintiff trust from having access to the lake and other areas of the trust’s property. Attorney Brangwynne and Ponte immediately filed a complaint in the Land Court, which included a claim for preliminary injunction, seeking the immediate removal of the chains and monitoring equipment.
The Court, after substantive briefing and oral argument, awarded the preliminary injunction in favor of the firm’s client. The order was issued on July 26, 2021, only days following the oral argument, requiring immediate removal of the chains and equipment.
